Booking Terms and Conditions
Migunga Adventures are trading names of Migunga Adventure Tours & Safaris, a company registered in The United Republic of Tanzania. The following terms as used in these Booking Terms and Conditions shall be considered synonymous: safari, tour, itinerary and trip, all of which refer to the travel arrangements being booked with Migunga Adventures. Additionally, the following terms: client, guest, participant, member, passenger and traveler all refer to you, as the traveler.
All tour prices quote will involves,
- Accommodation as or will be indicated in each itinerary, based on either twin-bedded rooms or double bed rooms (or tents where applicable).
- Meals as indicated in each itinerary, and domestic bottled water with group meals.
- Arrival and departure transfers and all other land transport.
- For Kilimanjaro and other mountains: Services of professional and licensed English speaking guides (or other specified International languages speaking guides), skilled cook, and enough number of porters for carrying your luggage, food, and water.
- For safaris: Services of English speaking driver guide (or other specified International languages speaking guide), and a skilled cook for camping safari.?
- Entrance fees to National Parks, game reserves and museums, and ALL other applicable fees and taxes.
- A Safari vehicle, equipped with luxurious game viewing and touring, with a guarantee window seat!
What may not include in tour prices: Costs of passports or visas; excess baggage charges; travel insurance; airfares and airport departure taxes (unless explicitly stated); sightseeing, game drives or meals not listed in the itinerary; personal expenses such as beverages, (other than bottled water as noted in Tour Inclusions), laundry, communication charges, and gratuities.
Reservations and Payments: A minimum deposit of 40% per person is required at the time you book. The remainder of the price of your trip is due 60 days prior to your departure date. Accepted methods of payments include,bank wire transfer, Western Union Money Transfer or Money Gram International( should be sent to Sylvester Lawrence Migunga).
Cancellations: Cancellations received by Migunga Adventures 60 days or more prior to departure are subject to a 30% per person cancellation penalty; Cancellations received 59-30 days prior to departure are subject to a penalty of 35% of the total retail tour rate; 28-21 days is 50% of the tour rate. Cancellations received 20 days or less are subject to forfeiture of 100% of the entire retail tour rate.
Guest Representation and Consent: The person making a booking warrants that he or she has authority to enter into a contract on behalf of all other persons included in such a booking. The payment of the deposit or any other partial payment for a reservation on a tour constitutes a consent by all guests covered by that payment to all provisions of the Terms and Conditions contained herein whether the guest has signed the contract or not.
Participation: Persons not fit for long trips due to heart disease, chronic illness, physical handicap, advanced pregnancy or mental illness should not participate in these travel programs unless otherwise the doctors recommends.
Alterations to tours: Migunga Adventures reserves the right to alter or modify the itinerary of any tour, if air schedule or surface transportation changes, security matters and/or events beyond its control make such alterations necessary.
Specific Accommodations: Accommodations and arranged sightseeing are subject to change at any time due to unforeseen circumstances or circumstances beyond Migunga Adventures. Every effort will be made to operate tours as planned, but alterations may occur after the final itinerary has been issued.
Special Requests: Specific requests such as connecting or adjacent rooms, smoking or non-smoking rooms and special dietary needs should be advised at time of booking. Please be advised that every effort will be made to secure your special request; however, they cannot be guaranteed.
Baggage: Baggage and personal effects are carried at owners risk throughout the tour. Luggage weight restrictions on some internal flights may apply; details will be provided on your itinerary.
Photography: Migunga Adventures may take photographs or film of its trips and trip participants, and participant grant Migunga Adventures express permission to do so and for Migunga Adventures to use such for promotional use.
Claims and Refunds: Except for verifiable extenuating circumstances, refunds are not made for any missed tour services. There will not be any refund if you cancel the tour that is in progress. For verifiable claims to be considered, they must be received in writing within 45 days of the termination of the tour and be accompanied by supporting statement from the Tour Operating Company verifying the claim.
Responsibility: Migunga Adventures employees, shareholders, officers, directors, successors, agents and assigns collectively Migunga Adventures, does not own or operate any entity which is to or does provide goods or services for your trip, including, for example, lodging facilities, transportation companies, local ground or safari operators, including, without limitation, various entities which may be affiliated with Migunga Adventures and/or which may utilize the Migunga Adventures name, guides, food and drink service providers, equipment suppliers, etc. As a result, Migunga Adventures is not responsible for any negligent or willful act or failure to act of any person or entity it does not own or control, nor for any act or inaction of any other third party not under its control.
In addition and without limitation, Migunga Adventures is not responsible for any injury, loss, death, inconvenience, delay or damage to personal property in connection with the provision of any goods or services whether resulting from but not limited to acts of God or force majeure, disease, illness, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, overbooking or downgrading of accommodations, food poisoning, mechanical or other failure of aircraft or other means of transportation or for failure of any transportation mechanism to arrive or depart on time.
Arbitration Agreement: Any controversy or claim arising out of or relating to these Terms and Conditions, to the limits on Migunga Adventures responsibility clause, to the brochure, to the flier, to any information relating in any way to the trip, to the trip itself, or to any products or services related to the trip, shall be settled solely and exclusively by binding arbitration in accordance with the Commercial Arbitration Rules of the Tanzania Arbitration statute, except that (a) in lieu of a personal appearance at arbitration, the arbitration may be conducted by telephonic means, (b) arbitration is the exclusive forum for dispute resolution (no court actions), and (c) except as otherwise provided by statute, each party shall bear its own costs and expenses and an equal share of the arbitrator and administrative fees.
Risks: There are certain inherent risks in adventure travel of the type involved here. These include, but are not limited to, risks of walking, climbing and swimming (for example dangers of rapidly moving water, rocks and other submerged objects, hypothermia, etc), horseback riding, (for example, unpredictable behavior by the horses, being spooked, etc) hiking, climbing mountains (for example, rock slides, falling stones, etc), walking safaris, downhill or cross country cycling, (for example, equipment failures, ice or other trail obstructions) and in all trips dangers of animals, inaccessibility to medical attention and difficulty in evacuation from remote locations in the case of a medical emergency. Traveler assumes all such risks with regard to these possibilities.
Any payment to Migunga Adventures constitutes your acceptance of the terms and conditions set out there in.
Prices Excluded: Accommodation in Arusha/Nairobi unless noted, health/evacuation insurance, soda/alcohol unless noted, visa fees, international airfare, local airfare unless noted, airport taxes, gratuities, laundry, sleeping bags and others not stated above as included. The prices are not negotiable also can change without notice, and festive season supplement apply in Christmas/new year based on type of accommodation requested.
Baggage: Baggage is restricted to one standard size bag while on safari due to limited space in the vehicle and road conditions. For scheduled flights within the parks the maximum baggage allowance is 15 kgs per person in soft bags. Excess luggage can be stored in the left locker room of most hotels or at our office.
Insurance: It is an express understanding and condition that any person taking safari with Migunga Adventures has an adequate and valid insurance cover against personal accident, medical attendance, and baggage and trip cancellation. In addition we highly recommend taking a Flying Doctors Evacuation tourist cover at a nominal fee of US $ 50 per person for a 14 days cover in Tanzania.
Alterations to Tours: The sequence of the itinerary and the accommodation of safaris are adhered to as far as possible. We reserve the right however to make alterations due to bad weather, road conditions, congestion or other causes. We also reserve the right to decline or retain a passenger as a member of any tour at any time.
Liability: The Company acts only as an agent of the passenger in all matters relating to tours and it accepts no responsibility for any personal illness, injury, accident, death, delay, loss, damage or irregularity of any kind, which may be occasioned by reason of any act or omission beyond its control, including without limitation, any act of negligence or breach of contract of any third party such as a hotel or airline, who is to, or does supply, any goods or services for the trip. Migunga Adventures will not be responsible for any losses or expenses due to delay or changes in schedule, overbooking of accommodation, fault of third parties, sickness, weather, strikes, acts of God or for any other cause beyond its control. All such losses or expenses have to be borne and paid for by the passenger.
Tanzanian law governs the Company’s liability to passengers carried in its own vehicle and all claims are subject to the jurisdiction of the Tanzanian Courts. Whilst every care is taken, the Company will not be held responsible for loss or damage to baggage, personal effects, valuables or currency. The Company reserves the right to employ sub-contractors for all or part of the services.
